On 6 March 2018 officials from the Guernsey and Jersey governments attended a workshop organised by the European Commission (DG TAXUD). The workshop was for those jurisdictions in Annex II of the conclusions of the 5 December ECOFIN which have been assessed as cooperative, having made commitments to address concerns identified by the EU Code of Conduct Group relating to economic substance. This relates to one of the criterion (criterion 2.2) used by the Code Group when screening the tax regimes of 92 non-EU jurisdictions during the course of 2017. The workshop will be followed by ongoing technical contacts between the Channel Islands and DG TAXUD as implementation of the commitments is taken forward in Guernsey and Jersey.
The letters of commitments to the Chair of the Code of Conduct Group by Guernsey and Jersey were published in December.
In the case of Guernsey, the letter is annexed to the statement by the President of the Policy and Resources Committee (the Chief Minister) to the Guernsey States Assembly on 13 December 2017 – see here.
In the case of Jersey, the letter is annexed to the statement by the Jersey Chief Minister to the Jersey States Assembly on 11 December 2017 – see here.
